Nye County Commissioners amended its data center policy to require developers to provide their own power, limit water use to 1.5 acre-feet per acre, maintain a 400-foot distance from residential properties, and enforce a sound limit. The ordinance continues the Southern Nevada Water District's ban on evaporative cooling for data centers and is scheduled to take effect on October 28.
During a three-hour public comment period, residents expressed opposition to the new rules despite their intent to limit data center development. Susie Hertz told commissioners, 'I really don't appreciate what you did. Shame on you,' to which Chair Ron Boskovich replied, 'No, shame on you.' Commissioners noted the ordinance is among the tightest in the state.
Confusion arose when timekeeper John Koenig admitted he had been using the wrong time limit for public comments for about an hour. After being corrected, he said, 'Oh s***,' before the timer beeped. Commissioners then suspended Robert’s Rules of Order, with Commissioner Ian Bayne asking, 'Can someone explain the rules then,' and Commissioner Bruce Jabbour observing that 'Clark County is laughing at us here in Nye County.'
